The U.S. Securities and Exchange Commission (SEC) is responsible for regulating the securities industry in the United States, including cryptocurrencies. Ripple’s relationship with the SEC has been a topic of much debate since XRP was classified as a security by some legal experts in 2018.

At present, the official stance of the SEC on XRP is that it does not consider it to be a security because its transactions are managed by an independent blockchain network rather than being centrally controlled by a single entity or organization. However, this position has not been officially confirmed or accepted by Ripple Labs Inc., which owns most of XRP’s supply and could potentially be held liable if regulators change their stance on whether XRP should be considered a security in future rulings.

In 2020, Ripple CEO Brad Garlinghouse expressed his view that “XRP should not be classified as a security,” but he also acknowledged that there is still some uncertainty about how regulators will ultimately decide to treat digital assets such as XRP and other cryptocurrencies when determining what qualifies as an investment contract under US law. As such, investors should proceed with caution when considering any investments related to cryptocurrency tokens like XRP and always do their own research before investing in any asset class or financial product.
