New York Department of Financial Services (NYDFS)
The New York Department of Financial Services (NYDFS) is the state regulator for all financial services in the State of New York. The NYDFS was formed in 2011 by merging two previously separate entities, the Banking and Insurance Departments. It has a broad range of regulatory responsibilities including banking, insurance, real estate transactions, mortgage loans and other consumer protections. In particular, it regulates virtual currency activities through its Virtual Currency Regulation Program.
Virtual Currency Regulation Program
The purpose of the NYDFS’s Virtual Currency Regulation Program is to protect consumers and root out money laundering activities by creating rules for businesses working with virtual currencies such as Bitcoin or Ethereum. Companies that wish to offer services related to virtual currencies must register with the NYDFS before engaging in any activity within this sector. After registering, businesses must comply with applicable regulations governing capitalization requirements and cybersecurity protocols among others which have been established by the department .
